    Colorado requires insurers to offer Medicare Supplement (Medigap) policies to individuals under age 65 during their six-month open enrollment period after enrolling in Medicare Part B. While insurers cannot deny coverage based on a person’s health or disability, they are allowed to charge higher monthly premiums for people under 65. By law, these premiums cannot be higher than the most expensive plan available for that coverage type. If the plan is new to the market, the premium for someone under 65 can be no more than 1.5 times the rate charged to someone age 65.

Insurers cannot deny coverage or base pricing on an applicant’s medical history or health status, and individual underwriting is prohibited. However, insurers are permitted to charge different premium rates for those under 65 and must maintain two separate rating pools: one for individuals with ESRD and one for individuals with other disabilities. Premium differences must be based on sound actuarial principles and reasonably reflect the cost of coverage. Despite these protections, Medigap premiums for ESRD patients under age 65 are typically much higher than those for other enrollees.

Medigap plans from HIPIOWA come with premiums set at 150% of the average market rate and are only available to individuals who meet certain high-risk medical criteria—such as kidney failure requiring dialysis. Guaranteed issue rights exist for specific life events, such as loss of employer coverage or disenrollment from a Medicare Advantage plan, but these protections do not specifically extend to individuals with ESRD under 65.
